GENERAL TERMS OF SERVICE

THIS IS AN AGREEMENT BETWEEN YOU OR THE ENTITY THAT YOU REPRESENT (hereinafter “You” or “Your”) AND ICEWARP LIMITED AND ITS SUBSIDIARIES (hereinafter “We” or “IceWarp”) GOVERNING YOUR USE OF ICEWARP PRODUCTS AND SERVICES. By accessing or using these products and services you agree to be bound by these General Terms of Service (“Terms”), and at the same time express your willingness to meet all the requirements arising out of this agreement at all times while you use Our products and services. To do so, you must review the most current version of the Terms, which may be amended from time to time.

Acceptance of the Terms

You can accept the Terms by checking a checkbox or clicking on a button indicating your acceptance of the Terms or by actually using Our products or services. You must be of legal age to enter into a binding agreement in order to accept the Terms. If you do not agree to the Terms, do not use any of our products or services.

IceWarp Copyright Notice

IceWarp software that is made available to download from this website is the copyrighted work of IceWarp and/or 3rd parties who have licensed their work to be used by IceWarp, as such is protected by copyright laws and international copyright treaty provisions. To learn more about use of the software from legal perspective, please refer to the License Agreement. Any other use is strictly prohibited.

IceWarp Trademark Notice

IceWarp name and logo is a registered trademark of IceWarp. or its subsidiaries in the United States, in countries which are members of WIPO and pending registration in other countries. No logos or trademarks may be removed, copied, altered or imitated in whole or in part, unless expressly permitted by the trademark holder.

End User License Agreement ("EULA")

The software license agreement applies to the installed version of IceWarp Server and is included with every download of IceWarp software in the root of the installation archive, in the /doc subfolder within the productinstallation directory, as well as on the web. You cannot use or evaluate any version of the software without reading and agreeing to the terms of the License Agreement.

In addition, these terms apply for the IceWarp software subscription payment method.

IceWarp Cloud - Terms of Service

This document is intended for customers of IceWarp Cloud and governs your use of the online services provided by IceWarp. You need to agree to it before accessing or using the service.

Cloud Micro-Services - Terms of Use

IceWarp offers single-purpose cloud services (for this purpose, called “micro-services”), which are hosted on infrastructure provided by IceWarp. In relation to on-premise customers, this means that some features in your installed version of IceWarp are provided as a service. Their use is subject to these additional terms.

Data Processing Agreement

When your organization uses IceWarp cloud services, including the accompanying desktop and mobile applications, micro-services operated on IceWarp's infrastructure including Documents, Conferences and others (applies to cloud customers), including Recordings and Dashboard (applies to on-premise customers), or when we access a server hosted on your premises that holds your data as a part of professional services such as the Migration service, IceWarp acts as a Processor and your organization acts as a Controller. In this case, we process personal data to perform contract for provision of products or services to your organization in line with Data Processing Agreement, which constitutes an integral part of this contract.

Remote Access Policy

If ad-hoc access to your system is necessary for provision of the service(s) such as data migration or incident resolution, you authorize our technician to use the access credentials you provide for a one-off period as may be necessary to perform the service(s), after which the credentials are safely expunged from our systems and it remains your responsibility to revoke the access.

Desktop Client 's Use of Google API

IceWarp Desktop Client allows users to set up accounts for online services such as G Suite, iCloud, Office365 and others. For this purpose, IceWarp complies with all necessary privacy terms of the respective providers to guarantee that their users' data will be used only for legitimate purposes (such as to compose and retrieve email). Desktop Client’s use and transfer to any other app of information received from Google APIs adheres to Google API Services User Data Policy ( https://developers.google.com/terms/api-services-user-data-policy#additional_requirements_for_specific_api_scopes ), including the Limited Use requirements.

Evaluation or Trial Versions

Evaluation/trial versions provide a way to obtain and evaluate software, giving users the opportunity to try a program on their own computer before buying it. This is typically referred to as "try-before-you-buy".

While evaluation versions are copyrighted, and the copyright holder retains all rights, the author specifically grants a user the right to freely evaluate and distribute the program, with limited exceptions outlined in the License Agreement included with every IceWarp Server installation.

After using an evaluation version for a defined trial period, the user must purchase a licensed copy or remove the evaluation version from their system.

Refund Policy

IceWarp makes every effort to ensure that you are 100% certain that IceWarp Server and all related products meet your requirements exactly before you purchase the software.

IceWarp Server and all related add-ons are available for a free 30-day trial. All software is unlimited use for this time period for up to 200 user accounts and is not otherwise limited in any way.

Additionally, to ensure that you are certain IceWarp Server is the right product for you, you can receive free web-based support related to technical problems during your trial period as well as free pre-sales support via our "Sales Chat" related to functionality, licensing and purchase questions.

The advantage of our try-before-you-buy strategy over normal store-bought software is that you can try all versions of IceWarp Server software before you buy it with no limitations on functionality. You install the software free of charge on your computer and evaluate it (even in production). If the software meets your exact needs and you wish to continue to use it, you may register it. If for some reason IceWarp Server software does not meet your requirements, you are under no obligation to purchase and you simply remove it from your computer using the included un-install.

As opposed to store-bought software that cannot be tested or returned after the box is open, IceWarp Server software can be fully tested for 14 days with no obligation to purchase.

So feel free to try out our software free of charge and our web-based support free of charge.

IceWarp Server doesn't need to be reinstalled or reconfigured after registering the full license, all features ordered will be immediately available for the licensed term. (This does NOT limit you to running IceWarp on the machine that it was licensed on. It can be easily migrated.)

Once we have released your license to you we cannot control the destiny of that license as there is no physical product to return to us. Thus we cannot accept refunds for licenses that have already been delivered to the customer either via email, fax, phone or mail.
